The Basics
topzite is a website hosting platform that lets you build and publish static websites. We provide the tools (CMS, templates, hosting) and you provide the content (text, images, your brand).
By creating an account or using topzite, you agree to these terms. If you don't agree, that's okay — but please don't use the service.
When we say "we", "us", or "our", we mean topzite, operated by Rory, a sole trader based in New Zealand. When we say "you" or "your", we mean you, the person using topzite.
Your Account
Signing up
To use topzite, you need to create an account. During the beta period, you'll also need an invite code. Here's what we ask:
- One account per person (no shared accounts)
- You must provide accurate information (a real email address, at minimum)
- You must be at least 16 years old
Keeping your account secure
You're responsible for keeping your login details safe. Use a strong password and don't share it. If you think someone else has accessed your account, let us know immediately at [email protected].
Your Content
You own your content
Everything you create and upload to topzite — your text, images, logos, and other media — belongs to you. We don't claim ownership over any of it.
What you give us permission to do
By uploading content, you give us a licence to host, store, cache, serve, and display that content as part of running your website. This is the bare minimum we need to actually deliver the service — we can't host your site without storing and serving your files.
This licence exists only for as long as your content is on topzite. Delete your content or close your account, and the licence ends.
Your responsibility
You're responsible for the content you publish. Make sure you have the right to use any images, text, or other material you upload. If you're using photos from a photographer, get their permission. If you're using stock images, follow the licence terms.
Our Platform
topzite — including the CMS, templates, build system, and all the code that makes it work — is our intellectual property. You're welcome to use it to build your site, but you can't copy, reverse-engineer, or redistribute the platform itself.
The templates we provide are for use on topzite only. You can customise them for your site, but they're not yours to take elsewhere.
Acceptable Use
We want topzite to be a good place. To keep it that way, you agree not to use the platform to:
- Publish illegal content — anything that breaks New Zealand law or the law of your own country
- Infringe copyright — don't use other people's work without permission
- Distribute malware — no viruses, scripts, or anything designed to harm others
- Spread hate speech — no content that promotes violence or discrimination against people
- Send spam — don't use your topzite site to send unsolicited messages or host phishing pages
- Impersonate others — don't pretend to be someone you're not
If we find content that violates these rules, we may remove it or suspend your account. We'll try to give you a heads up first, but in serious cases (like malware or illegal content), we may act immediately.
Payment & Billing
Pricing
topzite costs $5 NZD per month per site. That's it — no tiers, no hidden fees, no "premium" add-ons. Every site gets every feature.
Prices may be subject to GST (Goods and Services Tax) where applicable. We'll make this clear on your invoice.
How billing works
You're billed monthly for each active site. Payment is processed through our payment provider (currently being set up via Stripe). We don't store your credit card details ourselves.
Price changes
We may change our pricing in the future. If we do, we'll give you at least 30 days' notice before any price increase takes effect. You can always cancel before the new price kicks in.
Cancellation & Deletion
You can cancel anytime
There are no lock-in contracts. You can cancel your site or close your account whenever you want.
What happens when you cancel
When you cancel a site:
- Your site stays online until the end of your current billing period
- Once your billing period ends, your site goes offline — but we keep all your content and data for 30 days so you can reactivate if you change your mind
- After those 30 days, everything is permanently deleted
Want to take your site down sooner? You can delete it yourself at any time from the CMS.
When you close your account, all your sites follow the same process.
Exporting your content
We recommend downloading a copy of your content (especially images and text) before cancelling. Once your data is deleted, we can't get it back.
Availability & Uptime
We do our best to keep topzite running smoothly, but we can't guarantee 100% uptime. Things like server maintenance, infrastructure issues, or events outside our control may occasionally cause downtime.
The service is provided on an "as-is" basis. We don't make formal uptime guarantees or offer SLAs (service level agreements).
That said, we use reliable infrastructure (AWS and Cloudflare) and we care about your site being online. If something goes wrong, we'll work to fix it as quickly as we can.
Limitation of Liability
To the maximum extent permitted by law, our total liability to you for any claims arising from or related to topzite is limited to the amount you've paid us in the 12 months before the claim arose.
We're not liable for any indirect, incidental, or consequential damages — things like lost profits, lost data, or business interruption — even if we were warned they might happen.
This doesn't limit any rights you have under the New Zealand Consumer Guarantees Act (see below).
Consumer Rights (NZ)
If you're using topzite for personal or domestic purposes, you may have rights under the New Zealand Consumer Guarantees Act 1993 that can't be excluded by these terms.
Nothing in these terms is intended to limit or override those rights. Where the Consumer Guarantees Act applies, it takes priority over anything in this document that would conflict with it.
Indemnification
You agree to indemnify and hold topzite harmless from any claims, losses, or damages (including legal fees) that arise from:
- Content you publish on your topzite website
- Your violation of these terms
- Your violation of any third party's rights (e.g., copyright)
In plain English: if someone comes after us because of something you published on your site, that's your responsibility to sort out.
Copyright & Takedowns
We respect intellectual property rights and expect our users to do the same.
If you believe that content on a topzite-hosted website infringes your copyright, please contact us at [email protected] with:
- A description of the copyrighted work
- The URL of the infringing content
- Your contact information
- A statement that you believe the use is not authorised
We'll review the report and take appropriate action, which may include removing the content or disabling the site.
Termination
You can leave anytime
You can close your account and stop using topzite whenever you like. No hard feelings.
We can terminate for violations
We may suspend or terminate your account if you violate these terms — particularly the acceptable use rules. For serious violations, we may act immediately. For less serious issues, we'll try to contact you first and give you a chance to fix things.
What happens after termination
When your account is terminated (by you or by us), the cancellation process described above applies: your site goes offline, data is kept for 30 days, then it's permanently deleted.
Changes to These Terms
We may update these terms from time to time. If we make material changes — anything that meaningfully affects your rights or obligations — we'll give you at least 30 days' notice by email or by posting a notice on the website.
If you continue using topzite after the changes take effect, you're agreeing to the updated terms. If you disagree with the changes, you can close your account before they take effect.
The "Effective" date at the top of this page tells you when these terms were last updated.
Governing Law
These terms are governed by the laws of New Zealand. Any disputes will be resolved in the courts of New Zealand.
